Every year, each school district receives a Special Education Profile displaying the district's performance on key indicators. Each district’s superintendent and special education contact also receive information from the Ohio Department of Education about any required activities the district must undertake based on these indicators. This email is to notify you that, effective immediately, the initial individualized education program (IIEP) implementation date (start/effective date) must be used in the calculation for Indicator 12.
State Performance Plan Indicator 12 measures the percentage of students referred by Part C/Early Intervention prior to age 3 who are found eligible for Part B/LEA Special Education Services and have individualized education programs (IEPs) developed and implemented by their third birthdays (20 U.S.C. 1416(a)(3)(B), 34 CFR 300.124(b)). As a compliance indicator, the law requires 100 percent of children referred from Early Intervention (Part C) who are found eligible for Preschool Special Education (Part B) supports must have initial IIEPs developed and implemented before or on their third birthdays.
Please note that “implemented” means the IEP has been signed, and all identified services begin before or on the child’s third birthday, unless an alternative start date has been documented with a PR-01 (Prior Written Notice to Parents) due to parental choice, parent refusal to consent or the child’s health.
Please review and revise your district's policies, procedures and practices to include training of appropriate staff related to the use of the IIEP implementation date to ensure compliance for Indicator 12.
